Overview

This website is operated by Heirloom Haven Co, doing business as Tropical Moose ("we", "us", "our"). By visiting our site or buying from us, you agree to these Terms of Service ("Terms"), along with our Privacy Policy, Returns & Refunds policy and Shipping policy, which are part of these Terms. If you don't agree, please don't use the site.

1. Our store

Our store is hosted on Shopify. Products are made to order by our production partners. You must be at least the age of majority where you live to place an order, or have a parent or guardian's permission.

2. Products, colors and sizing

We work to show colors, designs and sizes accurately, but screens vary, and processes like embroidery and garment dyeing create small differences between pieces. Size charts are provided as a guide. We may limit quantities, change products, or stop selling any product at any time.

3. Prices and payment

Prices are in US dollars and may change without notice. Sales tax is added at checkout where required. If an item is listed at an obviously wrong price because of an error, we may cancel the order and refund you in full. We may refuse or cancel any order, including orders that appear fraudulent or are placed by resellers.

4. Discount codes and promotions

Codes can't be combined unless stated, have no cash value, may exclude certain products, and expire as stated. We may end or change a promotion at any time.

5. Shipping, returns and refunds

See our Shipping and Returns & Refunds policies. We'll help with lost or damaged packages as described there.

6. Accounts

If you create an account, you're responsible for keeping your login secure and for activity under your account.

7. Your content

If you send us photos, reviews or comments, or tag us (for example with #LiveTropical), you give us permission to use, reproduce and share that content in connection with Tropical Moose, with credit where practical. You confirm the content is yours and doesn't violate anyone's rights. We may remove any content for any reason.

8. Intellectual property

The Tropical Moose name, moose character, logos, designs, photos, videos and site content belong to us or our licensors. You may not copy, reproduce or sell them without our written permission.

9. Prohibited uses

You agree not to use the site for anything unlawful, to interfere with its security, to scrape or copy it, or to submit false information.

10. Third-party services

We use third-party services such as payment processors, shipping carriers and production partners. Their own terms govern your use of their services, and we're not responsible for them.

11. Disclaimer and limit of liability

The site and products are provided "as is" to the fullest extent allowed by law. To the fullest extent allowed by law, our total liability for any claim relating to a product is limited to the amount you paid for that product, and we're not liable for indirect or consequential damages. Some states don't allow these limits, so they may not apply to you.

12. Indemnification

You agree to hold us harmless from claims arising from your breach of these Terms or misuse of the site.

13. Governing law

These Terms are governed by the laws of the State of Oklahoma and applicable US federal law. Any dispute will be handled in the state or federal courts located in Oklahoma County, Oklahoma, unless the law requires otherwise.
